Terms of Use
Please read these Terms of Use (“Terms”) carefully. They are a legal agreement between you and RMPC (“Developer”, “we”, “us”, “our”) for the Trivia Latina app for Roku devices (“App”) and the website trivialatina.approku.com (“Website”). By installing, opening or using the App or Website you agree to these Terms and to our Privacy Policy (trivialatina.approku.com/privacy-policy/). If you do not agree, do not use them.

1. WHO MAY USE THE APP
You must be old enough to form a binding contract where you live, or use the App with the permission and supervision of a parent or guardian who accepts these Terms. The App is a general-audience entertainment product.
2. LICENSE
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Roku devices that you own or control, for your private, non-commercial entertainment. The App is licensed, not sold. We and our licensors keep all rights not expressly granted.
3. WHAT YOU MAY NOT DO
You agree not to: (a) copy, modify, translate or create derivative works of the App or its content; (b) reverse engineer, decompile or extract the source code or the question database, except where the law lets you despite this restriction; (c) scrape, bulk-copy, republish or sell the questions, answers, images, audio or other content; (d) remove or change any notices; (e) use the App in a public performance, broadcast, paid event or other commercial setting without our written permission (private gatherings and classrooms for non-commercial purposes are fine); (f) interfere with ads, the purchase system or the Roku platform, or try to unlock Premium without paying; (g) use the App unlawfully or in a way that harms others.
4. FREE VERSION, ADS AND PREMIUM
4.1 The App is free to download. Free users see ads from the Roku Advertising Framework at natural breaks. We do not choose or control the specific ads and are not responsible for their content or for products and services advertised.
4.2 Premium is an optional one-time, non-consumable purchase that removes ads and unlocks certain categories. It is purchased and billed through Roku Pay. The price is shown in the App before you buy and may change.
4.3 Payments, receipts, restoring a past purchase, taxes and refunds are handled by Roku under Roku’s terms. We cannot issue refunds ourselves and cannot see your payment details. Contact Roku support for billing problems. Restore your purchase on the same Roku account from within the App.
4.4 Premium is tied to your Roku account and is for your personal use. “One-time” means you pay once for Premium as it is offered in the App for the life of the App; it does not promise that the App, any category, or any feature will be maintained forever. We may add, change or remove content and features, with or without notice.
5. TRIVIA CONTENT — NO GUARANTEE OF ACCURACY
5.1 The App is for entertainment and general interest. Questions, answers, explanations and “Did you know?” facts cover geography, history, culture, food, sports, music, people, language, science and other topics about Latin America and the world.
5.2 Content has been compiled with reasonable care, but it has not been independently verified by human experts, and it may contain errors, omissions, outdated information or answers that are disputed. Facts such as records, populations, dates, rankings and borders change or are contested. Do not rely on the App as a source of fact for study, exams, work, legal, medical, financial or any other important decision. Check against reliable sources.
5.3 Names, places, flags, people, organizations and products are mentioned for educational and entertainment purposes only. Their appearance does not mean endorsement or affiliation. Nothing in the App expresses any political position on the status of any territory, border, government or dispute.
5.4 If you spot an error, please tell us at support@trivialatina.approku.com. We may correct it but are not obliged to.
6. INTELLECTUAL PROPERTY
The App, its code, design, text, original questions and explanations, graphics, music and sounds are owned by us or our licensors and are protected by copyright and other laws. “Trivia Latina” and related names and logos are our marks. Roku and the Roku logo are trademarks of Roku, Inc.; the App is not affiliated with, sponsored by or endorsed by Roku, Inc. Other names are the property of their owners and are used only to identify them.
7. FEEDBACK
If you send us ideas or suggestions, you grant us a free, worldwide, perpetual right to use them without obligation to you.
8. THIRD-PARTY SERVICES
The App relies on the Roku platform, Roku Pay and the Roku Advertising Framework. Those services are governed by their own terms and policies, and we are not responsible for them, for their availability, or for what they do with your data.
9. AVAILABILITY AND UPDATES
We try to keep the App working, but we do not promise that it will be uninterrupted, error-free, or compatible with every Roku model or software version. We may update, suspend or discontinue the App or any part of it at any time.
10. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP, THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SOME PLACES DO NOT ALLOW CERTAIN DISCLAIMERS, SO PART OF THIS SECTION MAY NOT APPLY TO YOU.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, AFFILIATES, CONTRACTORS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL OR USE, ARISING OUT OF OR RELATED TO THE APP, THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR WEBSITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH ROKU FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AND (B) CAD $50. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW, INCLUDING YOUR STATUTORY CONSUMER RIGHTS.
12. INDEMNITY
To the extent permitted by law, you agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.
13. TERMINATION
These Terms apply until ended. You may stop using the App at any time by removing it. We may suspend or end your license if you breach these Terms. Sections that by nature should survive (including 3, 5, 6, 10, 11, 12, 14 and 15) will survive termination.
14. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Subject to any mandatory consumer rights you have where you live, the courts located in Alberta, Canada have exclusive jurisdiction over disputes, and you and we consent to that jurisdiction. Before starting a claim, please contact us at support@trivialatina.approku.com and give us 30 days to try to resolve the problem informally. If you are a consumer in the EU, UK, Brazil or elsewhere with mandatory local protections, nothing here removes those protections or your right to bring a claim in your home courts.
15. GENERAL
These Terms and the Privacy Policy are the entire agreement between you and us about the App and replace earlier understandings. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor. If there is a conflict between a translation and the English version, the English version controls where the law allows. Roku’s terms for the Roku platform also apply to your use of the App on Roku.
16. COPYRIGHT AND CONTENT COMPLAINTS
If you believe content in the App infringes your rights, email support@trivialatina.approku.com with: your contact details, the work you claim is infringed, where it appears in the App, a statement that you have a good-faith belief that the use is unauthorized, and a statement that your information is accurate and that you are the owner or authorized to act for the owner.
17. CHANGES TO THESE TERMS
We may change these Terms. The “Last updated” date shows the current version, and changes are posted at trivialatina.approku.com/terms-of-use/. If you keep using the App after a change takes effect, you accept the new Terms.
